MISSION STATEMENT

The Mission and Objectives of the Canoe Club are as follows:

To conduct the Canoe Club’s business and the discharge of its responsibilities in accordance with its Operating Agreement.

To preserve the character and integrity of the Canoe Club community by enforcing the responsibilities contained in the Operating Agreement and the Declaration of Covenants, Conditions and Restrictions applicable to the Canoe Club and its Homeowner’s Properties.

To exercise prudent fiscal management while maintaining the proper level of Community services and preserving the assets of the Canoe Club.

To enforce by prescribed legal means the collection of delinquent Association dues.
-
To foster Community involvement through sanctioned events, clubs and projects.
-
To respect issues raised by Homeowners and give those issues a fair hearing.
-
To maintain a safe and friendly environment for all Homeowners to enjoy the Canoe Club.
-
To maintain and operate the Canoe Club as a private/members only facility.
PART A GENERAL
1. The following rules and regulations have been developed to provide efficient, safe and sanitary operations of the entire pool complex for the protection of members and their guests, and to ensure their enjoyment of the facilities. Failure to comply with these rules and regulations or with the direction of the pool staff may result in the suspension of privileges. The decision to suspend or cancel privileges will rest solely with the HOA Board.
2. The membership owner is responsible for ensuring that all members and guests of the owner’s household observe and comply with the rules, regulations and the direction of the staff. THE CANOE CLUB DOES NOT PROVIDE LIFEGUARD OR SUPERVISORY SERVICES FOR ANY AREA OF THE CLUB. MEMBERS USE THE CLUB AT THEIR OWN DISCRETION AND RISK. The membership owner is responsible to ensure that these rules and regulations are adhered to by all in the household and all guests.
3. Unless specifically provided otherwise, the word “pool” in these Rules and Regulations includes both the pool and the hot tub. The phrase “pool complex” includes all Canoe Club Recreation Center areas, which are normally available for access and use by the member and his or her guests. The term “pool enclosure” is the area inside the pool fence.
4. For the purpose of pool rules and regulations, an adult is defined as a person at least eighteen (18) years of age.
5. “Member” is defined as those residents maintaining membership in the Canoe Club and those family members dependants living at that same address as Member dependants.
6. The use of controlled substances; gambling, abusive, obscene or profane language, fighting, excessive use of alcohol, or other offensive or illegal actions is strictly prohibited within the pool complex.
7. The Canoe Club members or managers may, for good cause shown on its motion or upon written request, waive or modify any of the rules and regulations contained herein or make additions to these rules and regulations. Appropriate notification of such changes or additions will be provided to the membership.
8. A complete and current copy of the rules and regulations booklet will be posted on the
Canoe club bulletin board as well as the Club’s official website.
PART B RECREATION CENTER ACCESS

Keys are good for as long as you own your home or lot and should not be discarded. Lost keys will be replaced at the member’s expense. Contact the Club Manager for replacement of a purchased key. Keys reported lost will be deactivated. If an owner rents his property, it is the owner’s option to provide the key to the renter. The key cannot be shared. It can only be used by the owner and family or the renter and family. The owner remains responsible for any damage to the Recreation Center. In the event of the sale of your home or lot you shall return all keys to the HOA on by the day of closing.
PART C GUESTS

The following provisions apply to member guest privileges at the Canoe Club pool complex and pool enclosure.
1. Day Guests
a. Each household will receive annually, at no cost, a Day Guest Card which is good for eight (8) one day guest visits per year. Up to four guests may accompany the member and this will be considered a single one day visit. More than four guests up to a maximum six guests accompanying the member will result in the use of a second one day visit. No more than six guests will be permitted on any single day. Additional Day Guest Cards (good for 8 one day guest visits) may be purchased from the Club Manager at a cost of $25.00 each, a maximum of 8 additional Day Guest Card’s per year can be purchased by any Member. Any child still residing at the home of a Member up to the age of seventeen (17) will be allowed one (1) guest per day without the use of a Day Guest Card.
b. Members must accompany their guests and are required to present their Day Guest Card at time of entry to the pool complex.
2. Babysitters
Family babysitters with member’s child/children will be provided pool complex access at no charge upon presentation of the member’s membership card when bring the Members children to the pool. Family babysitters with Member’s child/children entering the pool complex must be fourteen (14) years of age or older.
PART D POOL

1. Pool Operating Hours
The pool will usually open for the season on the Saturday of Memorial Day weekend and close on the Tuesday after Labor Day. The regular hours of pool operation are: 8:00 a.m. to 11:00 p.m., seven days a week.
2. The system for controlling the use of the pool during regular pool operation is as follows: Entry to the pool complex will be through the front door of the clubhouse. Each member is then required to register and present their membership card and Day Guest Card, if applicable, when they enter the pool complex.
3. All children under nine (9) years of age must be supervised into the pool enclosure by an individual who is at least thirteen (13) years of age and that individual must remain in the pool enclosure with the child and be responsible for full supervision of the child. The maximum number of children supervised by an individual in accordance with this paragraph is four (4).
4. A child between thirteen (13) and sixteen (16) may be unaccompanied within the pool enclosure provided they meet both of the following requirements:
a. They have passed a basic swimming (Red Cross Beginner in Swimming) test and present proper documentation to that effect.
b. A parent’s permission has been given in writing for the child to be unaccompanied.
5. Children either (9) and under years of age shall not be permitted in the pool enclosure unless accompanied by an individual who is at least thirteen (13) years of age; and who shall remain within reaching distance of the child at all times. Parents or other individuals accompanying said children SHALL NOT leave the children unattended in the pool enclosure.
6. No pets are allowed within the pool enclosure except those trained for assisting a handicapped person and accompanying that person.
7. Members are not permitted to swim in the Lake at any time as it is not tested on a regular basis. All swimming shall be in the pool or hot tub.
8. Eating at the tables around the pool will be allowed as long as it does not create any trash/safety/health issues. Beverages will be permitted in the pool area provided they are in appropriate containers, (metal or plastic). Glass containers are strictly forbidden. Food wrappings and other trash must be placed in the designated containers provided.
9. No person shall use the pool unless it is open. Unauthorized swimming while the pool is closed will result in the suspension of pool privileges for the season.
10. No glass or other sharp, breakable, or otherwise hazardous objects or toys shall be permitted within the pool enclosure. Plastic swim masks, goggles and unbreakable eye or sunglasses will be permitted.
11. Toys or balls, inflatable devices, swimming accessories and squirt guns are allowed to the extent that they do not interfere with the safety or enjoyment of any.
12. No person shall use the pool that has a skin disease, open sore, excessive sunburn, sore or inflamed eyes, cold, nasal or ear discharge, and communicable or contagious disease, or who is wearing bandages of any kind.
13. It is required that all individuals shower before entering the pool.
14. All individuals, including children, shall respect the diversity of pool attendees and wear appropriate swimming attire while using the pool facilities. Also note that shorts or cut-off jeans are not considered appropriate attire and will not be permitted in the pool.
15. Children who are not toilet-trained must wear swim diapers.
16. Lounge chairs are not reserved for the day. If the majority of the time is spent swimming, please have the courtesy to allow someone wishing to sit or sunbathe to use the lounge chair.
17. Pool users must not endanger the health or safety of self or others. Examples would include jumping off the side of the pool into the water, sitting or standing on the shoulders of another person in the pool or doing cartwheels into the pool from the pool deck. No jumping or diving of any kind, including from the waterfall is allowed. Any parents or adults supervising children allowing such activity will be considered in violation of Club rules and face disciplinary action outlined in Part G #5.
18. The moderate use of alcohol should be discrete out of respect for the views of a diverse membership. The use of controlled substances is strictly forbidden.
19. After using the sand beach it is absolutely prohibited to wash your feet in the pool or hot tub. This sand in the pool causes a tremendous cost to clean and maintain. All Members must wash your feet in the buckets provided by the beach or use personal towel to clean one’s feet.
PART E EXERCISE ROOM

Rules for the use of the exercise equipment have been posted and you are asked to read them and follow those instructions when using the equipment. In the interest of personal safety no one under the age of fourteen years old (14) will be permitted to use the equipment unless accompanied by a member parent or guardian. Damage to equipment resulting from its misuse or abuse will be charged to the member. Particular care should be taken not to bang the weights of the weight machine, as this will damage both the weights and the machine. Any equipment operating problems or missing components should be promptly reported to the Manager.
There should be no use of equipment not operating properly as this could cause further damage or injury. It is the responsibility of all members using the exercise equipment to abide by the following basic rules:
- Be courteous to fellow members when using the various machines.
- Use the machines correctly and avoid abusing the equipment.
- Leave the machines in start-up position if possible for the next member.
- Do not allow any water to come in contact with the machines – if water is accidentally spilled, please wipe it up immediately.
- Please dry yourself before using the equipment. No wet swimsuits are allowed on the machines.
- Turn off machines after completing your exercise regimen.
- Turn off lights, television & fans upon exiting the exercise room.
PART G RENTAL OF CLUBHOUSE

1. General
The clubhouse can be reserved for parties and other activities only by members. Reservation requests are to be submitted to the Manager at least three weeks in advance of the requested date.
The Pool can not be reserved.
Reservation requests should include the following:
- The name, address and telephone number of the member making the request.
- The date being requested. The desired start and end times of the event. The rental times normally will be scheduled from 11:00 noon until 5:00 p.m. Monday through Friday ONLY. A close approximation of the number of people attending the event.
- Whether or not alcoholic beverages will be served. If alcoholic beverages are brought into the clubhouse, the member must make arrangements for a certificate of insurance to be issued under the member's homeowner’s liability policy showing The Canoe Club, LLC. as being an "additional insured" under that policy.
The Canoe Club’s liability insurance does not cover the serving of alcohol.
No sale of alcoholic beverages is permitted because that requires a retail liquor license, which the Canoe Club does not possess.
- If it is intended to decorate the Clubhouse, the type and placement of those decorations must be approved in advance by the Manager to assure that no damage to the facility will result from their use. All decorations must be removed at the end of the event.
- The following rental restrictions must be strictly adhered to:
- All activities must end by 5:00 pm
- No form of gambling is permitted.
- The use of controlled substances (drugs) anywhere on Recreation Center property is strictly prohibited.

Evening Rental
Evening rental of the clubhouse will be allowed Monday through Thursday only - Evening reservation hours will be allowed from 5pm to 11:00pm by members only. Reservation requests must be submitted at least three weeks in advance of the requested date. When making a reservation keep in mind that the Canoe Club will still be open to other members. Reservations must be in writing and should include:
Monday through Thursday 5pm to 11:00 pm
• $150 non-refundable deposit, $500 refundable cleaning deposit
• Name, address, telephone number of the member making the request
• Date and time of reservation, all events must end at 11:00 pm, this includes cleaning of the clubhouse
• The number of people who will be attending, if you will be serving alcohol you must also submit a copy of certificate of insurance under the member’s homeowner’s liability policy showing the Canoe Club, LLC, as being an “additional insured”. The Canoe Club insurance will not cover the serving of alcohol.
There will be a mandatory walk through inspection to take place before and after event with manager and member. If there is any damages or cleaning required expense will be taken from the $500 cleaning deposit. If damages or cleaning required exceeds the $500 deposit member will be billed for cost and will not be permitted to reserve the clubhouse in the future.
If you will be decorating, you must return the Clubhouse to the condition in which it was found.
No gambling is permitted.
No illegal activity of any kind will be permitted.
All activity shall end at 11:00pm.
The cleaning deposit will be pro-rated back if there are any damages or cleaning that is not done.

• $250 non-refundable deposit, $500 refundable cleaning deposit
• Name, address, telephone number of the member making the request
• Date and time of reservation, all events must end at 11:00 pm, this includes cleaning of the clubhouse.

4. Fees
a. There will be a non-refundable usage fee of $100.00. In addition, there will a $250.00 refundable deposit to cover the cost of any cleanup, breakage or damage. Please note that Members will be held financially responsible for all breakage, damage, or cleanup expense resulting from the event. Members restoring the facility to its pre-event condition will not be subject to any cleanup costs.
5. General Rental Guidelines
a. The Clubhouse facilities may be reserved only Monday through Friday, except as outlined in sections b & c below, between the hours of 11:00 a.m. and 5:00 p.m. If the event occurs during the pool season, the pool may be used by the guests of the Members party but the pool can never be reserved for any event. When making a reservation you must state the area you wish to use, i.e the kitchen or the patio and grill. No Member will be allowed to reserve the entire Clubhouse, but only specific area’s to help add a level of privacy to their own party events. The Manager will have discretion when booking all reservations as to conflicts with multiple parties and area’s being reserved as to allow multiple bookings on same day.
b. There will be no reservations taken for the Canoe Club on major holidays as listed:
New Years Day
Superbowl Sunday
Easter
Memorial Day
July 4th
Labor Day
Holloween
Thanksgiving Day
Christmas Eve/Christmas Day
These dates are reserved for general Membership parties or simply open to all Members to enjoy. These parties may be funded by the Club or by the general Membership but will be open to all Members.
c. No reservations will be taken from Members who are not in good standing with the Club,
i.e delinquent on Club or HOA dues, or whose Club privileges have been suspended for violation of Club rules.
d. Deposits and rental fees are due within seventy two (72) hours of making the reservations and should be tendered in a separate check for each. Payment not made within this time period will cause the reservation to be cancelled and make the requested date available for rental by other members.
e. The Club’s Board of Directors will take requests from Members for full Clubhouse reservations for major events, i.e Wedding receptions, Anniversary celebrations, etc. This type reservation will be limited to only 12 days per year, no more than 1 per month in any single month, and will not be taken on dates listed in Section 3 (b). This type reservation will require a non-refundable rental fee of $1000.00 and a refundable deposit of $500.00. Hours for such reservations will be from 11:00am until 10:00pm.
6. Catering Kitchen
a. The Recreation Center is equipped with a catering kitchen for use by those persons renting the Activity Room who will be serving food and/or beverages. This kitchen is to be used only for food warming or serving. It is not equipped or approved for food preparation and is not to be used for that purpose.
b. Users will be expected to leave the kitchen in the same clean condition in which it was found. Failure to do so will result in the cost of clean up being deducted from the rental deposit.
7. Violation of Rules
a. All Members are urged to read the Club rules and if they do not understand any portion of them to contact a Board Member for clarification. The Club Manager and Club Board will be responsible for the enforcement of all Club rules. All Club Members should immediately notify the Club Manager or a Board Member if they believe a Club rule is being violated by another Member or non-Member.
b. The violation of any Club rule will result in suspension of Club privileges as follows:
1st violation: Written Warning
2nd violation: 30 Day Suspension of Club privileges
3rd violation: Board imposed suspension of up to 1 year
c. Club Members who are not current with their dues will have all privileges suspended and access cards deactivated once their account reaches 60 days delinquent. Upon receipt of payment their Club privileges will immediately be reinstated by the Club Manager.
PART H VEHICLE AND BICYCLE PARKING

General parking facilities are provided on the side of the Recreation Center. Handicapped parking is provided in the specially marked handicapped spaces on the west side of the Recreation Center and is to be used only by vehicles with handicapped parking identification. A bicycle rack is located adjacent to the general parking area and bicycle parking is limited to this area. It is recommended that bicyclists bring a chain and lock to secure their bikes as the Homeowner’s Association assumes no responsibility for loss or damage to bicycles.
